Karnataka Employers’ Association (KEA) in collaboration with BCP Associates (BCPA) concluded a high impact seminar on “Trend Setting Judicial Cases & Issues in POSH“ at Taj Vivanta, Bangalore on 25th April 2018. Key speakers for the event were Mr B.C. Prabhakar, President, KEA and Mr Devappa Gowda.
About the POSH Seminar
The POSH (Prevention of Sexual Harassment of Women at Workplace) landscape in India has been continually evolving and hence this seminar assumed huge significance and had over 200 delegates representing over 90 organizations from across India. Since the time the Act came into force, there have been a good number of decided cases on different provisions of the POSH Act and several of which involve complex and intricate issues in POSH. Mr. B. C. Prabhakar identified several such cases that were relevant and articulated the complexities of the cases and discussed the judgements for the benefit of the participants. The seminar mainly addressed the POSH aspects in length supported by judicial trends:
- Whether physical contact irrespective of intention can be construed as Sexual Harassment?
- Whether the physical presence of witness in the inquiry can be dispensed with?
- Composition of IC, Role of external member and correct manner to conduct inquiry?
- Aspects like Interim relief and action that Companies must take in light of changing landscape?
The second half of the seminar showcased organizations with best practices in the area of POSH – GE India and Akamai Technologies, which was followed by an expert panel discussion.
“If You Don’t Like It, Say It” Campaign Launch
During the seminar, BCP Associates formally launched the POSH campaign – “If You Don’t Like It, Say It“. The belief and rationale behind the campaign slogan is for employees and workers to inculcate a proactive approach to discourage sexual harassment at the workplace much before it occurs. In the coming months, we will be working with several companies to roll out the “If You Don’t Like It, Say It” campaign. We look forward to sharing our experiences from the campaigns.
